How Should You Select a Divorce Attorney?

A divorce means change — changes in family structure, in relationships, in finances. Even when the divorce is relatively amicable, it is important to establish rights and obligations so that everyone affected by the decree understand what is expected.

What are your objectives for the divorce process? When going through a divorce, it is critical to have a counselor who can guide you through the process and help you through emotionally charged decisions that can affect you for years to come. Because of this, the most important role we serve is that of counselor. Tell your divorce lawyer about your expectations and the results you want and/or need. By knowing your objectives, we are better able to develop an appropriate strategy for you.

What about custody and child support? When minor children are involved, their best interests should be the concern of both parents. Determining primary custody, joint custody and parenting time (visitation) needs careful thought. Child support is based on a state formula that we can explain to you. We can also counsel you on when deviations from the guidelines (whether upward or downward) would be beneficial to your interests.

How will the property be divided? It is always best when the parties can work out a division of property agreement. All marital assets and debts should be divided in a fair and equitable manner. Make sure you include all marital property — in other words, all property obtained during the marriage. That includes real estate, 401(k) plans, retirement plans, stocks, stock options, jewelry, motor vehicles. Does a business need to be divided? Have there been charges of domestic violence? If anger has turned to violence, if one spouse has accused the other of domestic violence, talk to a lawyer.

Will your divorce include alimony or maintenance? Alimony (in Indiana) or maintenance (in Kentucky) is generally based on one party's need and the other party's ability to pay.
