Thrown in Jail for not meeting financial order.

xThis is a legal question and perhaps turning into a political question;

I am in Colorado. I went through a divorce almost 3 years ago where I was handed a very unfair judgment against me financially. (child support, Spousal maintenance & estate buy out). Most of which is predicated on lies by my ex-wife that the judge insisted on believing and implementing. I have not been able to keep up with these payments as I knew I wouldn’t. The system has now come after me and revoked my driver’s license to start. Then my ex-wife filed a contempt of court citation that resulted in a warrant being issued for my arrest. I was arrested, put in jail and I am out on bond. I have been out for 10 months and I recently went back into court with this same judge and she says, I have to pay the back payments due of a total of 12,000 or she said she will put me back in jail until I some how get that paid. I proved to the judge that day clearly how much money I am making through my bank account and my 1099’s and her response was, “I don’t believe you”. I filed for bankruptcy last year, my house was foreclosed on, and I am fighting for my life here. In a nut shell I have a judge up here that is determined to put me in jail or pay money that I do not have. Where can I find justice? Can I move this to another venue? I was told since she was the original divorce judge and the case is documented in her court, and I cannot over ride this and get it moved without her permission. I am in a desperate position. I currently have a court appointed attorney (by this judge) that I am starting to feel is in on this too, as things seem to be going from bad to worse. I love this country and I have been a tax paying, law abiding citizen my whole life. I am in my 40s so I am bewildered and beyond being in shock that this is happening to me in this great country of ours. I am slowly losing any hope of getting results in court and starting to turn to the media and web sites like this to get answers or expose this injustice for what it is. This judge is young and already has a bad reputation among all men that have gone through her court in a divorce. I am starting to feel that every Attorney up here is terrified of her as well or else in on it with her. I am in deep trouble up here. Can some body please, please help me? Sincerely, David.

get legal assitance...

One of the most common mistakes I have seen in my life, with friends and whatnot getting divorces, is avoiding professional help. Your situation seems very complicated and you need to contact a local legal pro who can actually tell you what your rights are - you can't do it on your own.

A lot of men and women think that if you avoid paying for legal help they will save money, but usually it is the opposite and they will end up losing money in the long run. You need someone to guide you and it should be more than just help from a forum - get whatever professional help you can afford!

find a way to get a lawyer

I almost got tossed in jail for not being able to pay support. I had an ass hat for a Judge and a wife with big family money behind her.

I would get some legal help, HOWEVER take your time choosing a lawyer.. I am on my 3rd and I interviewed them all. I have been disappointed but mostly with CA law. My lawyer has their hands tied most of the time..
